3. Products and Services

UrbanLeaf AU offers a variety of indoor plants and related products for sale through our Site. All product descriptions, including plant care information, are provided for informational purposes only. We strive to ensure that all information on our Site is accurate, but we cannot guarantee that all information is complete, reliable, current, or error-free.

Product images are for illustrative purposes only. Due to the nature of plants, there may be variations in size, shape, and color from the images displayed on our Site. Plants are living organisms, and their appearance can vary based on environmental factors, seasonality, and growth stage.

We reserve the right to discontinue any product at any time. Any offer for any product or service made on this Site is void where prohibited.

4. Ordering and Payment

When you place an order through our Site, you are making an offer to purchase the products you have selected. We reserve the right to accept or decline your order for any reason. After placing an order, you will receive an order confirmation email, which constitutes our acceptance of your order.

All prices listed on our Site are in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change without notice. We reserve the right to correct any errors or omissions, and to change or update information at any time without prior notice.

Payment must be made at the time of ordering. We accept various payment methods as indicated on our Site. All payments are processed securely through our payment gateway providers. By providing your payment information, you represent and warrant that you have the legal right to use the payment method you have selected.

5. Shipping and Delivery

UrbanLeaf AU ships products within Australia only. Shipping costs and estimated delivery times are provided during the checkout process. While we aim to meet all delivery timeframes, we cannot guarantee specific delivery dates or times.

Risk of loss and title for items purchased from our Site pass to you upon delivery of the items to the carrier. It is your responsibility to file any claims with carriers for damaged and/or lost shipments.

We take great care to package plants securely for transport. However, due to the nature of live plants, there is an inherent risk of damage during shipping. If your plant arrives damaged, please contact our customer service team within 48 hours of delivery with photographic evidence of the damage.

6. Returns and Refunds

We want you to be completely satisfied with your purchase. If you are not satisfied with your order, please contact us within 7 days of receiving your items to arrange a return or refund. Different return policies may apply to different products, particularly for live plants.

For live plants, we offer a 14-day guarantee from the date of delivery. If your plant dies or shows significant decline within this period despite following our care instructions, please contact us with photographic evidence of the plant's condition.

Refunds will be processed using the original method of payment, excluding shipping costs, unless the return is due to our error or a defective product, in which case shipping costs will also be refunded.

7. Intellectual Property

All content on our Site, including text, graphics, logos, images, and software, is the property of UrbanLeaf AU or its content suppliers and is protected by Australian and international copyright laws. The compilation of all content on the Site is the exclusive property of UrbanLeaf AU and is protected by Australian and international copyright laws.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or its content without the express written permission of UrbanLeaf AU. You may not use any UrbanLeaf AU trademarks or service marks without our prior written consent.

Any feedback, comments, or suggestions you provide regarding the Site or our Services is entirely voluntary, and we will be free to use such feedback, comments, or suggestions without any obligation to you.

Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount paid by you to UrbanLeaf AU during the six (6) month period preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless UrbanLeaf AU, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Site using your account.

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within New South Wales, Australia.
